I am an experienced commercial litigator and Chair of Devine Millimet’s Financial Services Litigation Practice Group. Much of my practice concerns consumer financial services litigation, where I represents banks, mortgage lenders, mortgage loan servicers, and automotive finance companies in litigation in federal and state courts. Cases frequently involve challenges under federal statutes, including the federal Real Estate Settlement Procedures Act, the Truth in Lending Act, the Fair Debt Collection Practices Act, the Telephone Consumer Protection Act, and the Fair Credit Reporting Act, as well as claims under state unfair and deceptive acts and practices statutes and common law. I have represented lenders, master servicers, and special servicers enforcing secured and unsecured loan obligations, and I also have experience defending commercial and consumer lenders in litigation in a variety of state and federal courts and jurisdictions.
I also have substantial commercial litigation experience in state and federal courts representing clients involved in partnership and business disputes, as well as claims against other parties involving breach of contract, torts, consumer protections statutes, and various other types of litigation. I have tried numerous cases, regularly attend arbitration and mediation proceedings, and have experience in all facets of commercial litigation.
I also practice in the firm’s Family Law Practice Group where I represent individuals in divorce and related family matters in all facets related to the divorce process and post-divorce issues. I have tried several divorce and post-divorce matters.
As a litigator, I assess every case early in an attempt to minimize disputes and achieve early resolution so as to avoid prolonged and costly litigation. In the event a matter cannot be resolved immediately, I am experienced and prepared to litigate your case fully to protect your interests.
As a father of two daughters, I enjoy being active in their school and extracurricular activities. As a family, we enjoy skiing, camping, and managing a hyperactive dog, and I try to drag my daughters up a few of New Hampshire’s 4,000-foot mountains each year.

- Obtained favorable verdict in two-week jury trial concerning a challenge to a lender’s enforcement of a mortgage provision.
- Obtained summary judgment on behalf of lender related to claim by plaintiff home owner that lender violated state’s consumer protection statute through its review of plaintiff home owner for a loan modification.
- Obtained grant of petition for guardianship for client seeking appointment as guardian over grandchild
- Obtained dismissal of plaintiff’s claim that lender violated statutory power of sale and right to reinstate paragraphs contained in mortgage.
- Achieved verdict at trial concerning a borrower’s challenge a lender’s right to enforce a note and foreclosure pursuant to terms of mortgage.
- Obtained verdict denying a motion to modify parenting plan and child support orders.
- Represented lender and property preservation company in obtaining summary judgment as to claims of trespass to property and conversation claims advanced by tenant borrower.
- Successfully negotiated settlement on behalf of auto lender related to claims that lender violated various state statutory and common law after repossessing vehicle.
- Obtained early case dismissal for lender related to plaintiff home owner’s claim of wrongful foreclosure.
- Obtained summary judgment on behalf of lender related to claims of wrongful foreclosure of rental property and claims that lender failed to strictly comply with state foreclosure statutes.
- Obtained dismissal of claims advanced by bank customer that bank improperly cashed checks submitted by customer’s employees that allegedly lacked authorization to issue checks.
- Through commercial loan workouts and litigation, successfully represented lenders in multiple suits to collect on commercial loans after default.
