The Attorney Conduct, Liability and Professionalism Group provides New Hampshire and regional law firms and individual practitioners with assistance in legal malpractice actions, professional disciplinary proceedings, character and fitness committee inquiries, client fee disputes, opinions on a full range of ethical issues, conflict analysis, and the preparation or defense of disqualification motions. We provide expert opinions and testimony on professional responsibility issues in all forums and for all parties. We also consult with law firms on issues ranging from website advertising and ancillary businesses to partnership dissolution.

Attorney Conduct, Liability and Professionalism

Our practice group includes several seasoned practitioners, including co-chair Mitch Simon, a professor at the University of New Hampshire School of Law and long-term member of the Bar's Ethics Committee; co-chair Peter Beeson, a trial attorney with extensive experience in legal malpractice and disciplinary proceeding defense and a member of the Bar's Ethics Committee; Andy Dunn, a recognized expert on legal malpractice defense and insurance coverage issues; and Bob Dewhirst, a seasoned trial lawyer and former member of the Supreme Court's Professional Conduct Committee.

Members of the group are available to provide training on a full array of professional responsibility issues. Areas of key concern to today's lawyers include multi-jurisdictional or "cross border" practice; risk management; ethical marketing, website advertising and the use of social media; client misconduct; law firm mergers and dissolutions; and changes in New Hampshire's professional responsibility rules implemented by New Hampshire's Supreme Court effective January 1, 2008. Professor Simon is also available, with other members, to provide customized training programs to address the particular needs of lawyers and their firms.

The Attorney Conduct, Liability and Professionalism Group provides e-Advisories on the Law of Lawyering in New Hampshire, which analyze recent Supreme Court decisions, opinions of the NHBA Ethics Committee and ABA opinions under the Model Rules of Professional Conduct. The e-Advisories are intended to provide general overviews of professional responsibility law. Because the law in this field is constantly changing, and because the e-Advisories are generic, they should not be relied upon as guidance or advice on how to handle specific situations.
