NH Supreme Court Rules for Harbor Homes



Litigation Partners Tom Quarles and Lee Smith worked with the Disabilities Rights Center on a class action case that challenged the State of New Hampshire’s decision to prevent Devine Millimet’s client, Harbor Homes, a provider of community–based mental health residential and care services, from continuing to provide Medicaid funded mental health services to the 140 clients it served in 2011.  The New Hampshire Supreme Court ruled on June 18, 2014 that the state Department of Health and Human Services violated the Medicaid free-choice-of-provider provision when it terminated Harbor Homes as a Medicaid provider and forced its clients to seek mental health care from the state’s designated provider.  Attorney Quarles who represents Harbor Homes concludes, “This was a critical ruling and now means we’re back in the business of providing important services for any Medicaid enrollee who wants to resume their mental health care at Harbor Homes.” The case was remanded to the Superior Court where Harbor Homes will pursue monetary damages for three years of lost Medicaid revenues.
